Welcome to TributeWall. These Terms of Service ("Terms") govern your use of our website and services. By creating an account or using TributeWall, you agree to these Terms. Please read them carefully.

1. About These Terms

TributeWall ("TributeWall," "we," "us," or "our") is a celebration and tribute platform operated by BillCore, LLC, based in Minneapolis, Minnesota, USA. These Terms form a binding agreement between you and TributeWall. If you do not agree, please do not use the service.

2. Who Can Use TributeWall

You must be at least 18 years old to create an account and a tribute wall. By using the service, you confirm that you meet this requirement and that the information you provide is accurate. You are responsible for keeping your account credentials secure and for all activity that occurs under your account.

3. Creating and Managing Your Wall

TributeWall lets you create a wall where contributors can share photos, videos, audio messages, and written messages to honor someone. As the wall owner, you control its privacy (including the optional password) and are responsible for the content posted to it, including content contributed by people you invite. You may delete posts, photos, and comments, pin posts, and manage contributors through your dashboard.

4. Your Content and Ownership

You and your contributors retain ownership of the photos, videos, audio, and messages uploaded to your wall ("Your Content"). You grant TributeWall a limited license to host, store, display, and process Your Content solely for the purpose of operating and providing the service to you. We do not claim ownership of Your Content and we do not sell it.

You are responsible for ensuring you have the right to share any content uploaded to your wall — including photos that contain other people or minors — and that it does not infringe the rights of others. You are also responsible for informing your contributors that their contributions are collected on your wall.

To keep TributeWall a safe and respectful space, you agree not to:

6. Plans, Pricing, and Billing

TributeWall offers a free trial as well as paid plans, including monthly, yearly, and a one-time lifetime option, at the prices shown at signup (for example, $9.97/month, $59/year, or $129 lifetime). Optional add-ons, such as the Photo Mosaic, are billed separately as described at the time of purchase.

Paid plans are billed through our third-party payment processor. Recurring plans renew until cancelled, and you may cancel at any time. You are responsible for any applicable taxes. We may change our pricing on a going-forward basis; changes will not affect a plan term or one-time purchase you have already paid for.

7. Cancellations and Refunds

You may cancel your subscription at any time through your dashboard or by contacting us, and your wall will remain accessible according to your plan terms. For questions about refunds on subscriptions, the lifetime plan, or add-ons, please contact us at info@tributewall.com before purchasing.

8. Downloading and Deleting Your Content

You can download all collected photos, videos, audio messages, and written messages as a complete archive. You may also request deletion of your wall and associated content. Once deleted, content may not be recoverable, so we encourage you to download a copy first.

9. Intellectual Property

The TributeWall name, logo, website design, and software are the property of TributeWall and its licensors and are protected by intellectual property laws. These Terms do not grant you any right to use our branding without our prior written permission.

10. Service Availability

We work hard to keep TributeWall available and reliable, but we do not guarantee uninterrupted access. We may modify, suspend, or discontinue parts of the service, and we will make reasonable efforts to give notice of significant changes that affect active walls.

11. Disclaimers

The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the service will be error-free or that content will always be preserved without loss, though we take careful measures to protect it.

12. Limitation of Liability

To the fullest extent permitted by law, TributeWall and its owners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising from your use of the service. Our total liability for any claim relating to the service will not exceed the amount you paid us in the twelve months before the claim.

13. Indemnification

You agree to indemnify and hold harmless TributeWall and its owners from any claims, damages, or expenses arising out of your content, your use of the service, or your violation of these Terms.

14. Governing Law

These Terms are governed by the laws of the State of Minnesota, USA, without regard to its conflict of laws principles. Any disputes will be subject to the exclusive jurisdiction of the courts located in Minnesota, unless otherwise required by applicable law.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the service after changes take effect constitutes acceptance of the updated Terms.
